Position Summary: Under the direction of the Senior Executive Deputy Counsel, the Attorney provides general litigation support, as well as analysis and support on the implementation of Federal and State regulations and policy having significant financial, procedural, or policy consequences and of major importance to the New York City Public Schools (NYCPS), General Counsel, Executive Deputy Counsels, and Senior NYCPS officials, and which have the potential for broad impact on the education policy and goals of the school system. Performs related work. Reports to: Senior Executive Deputy Counsel Direct Reports: N/A Key Relationships: General Counsel, Executive Deputy Counsels, NYCPS attorneys, Division of Information and Instructional Technology (DIIT), Division of Contracts and Purchasing (DCP), Office of Capital Grants and Finance, Division of Financial Operations (DFO), Deputy Chancellor for Operations, Law Department, Division of Safety and Youth Development, Law Department, and other internal and external offices as assigned. Responsibilities
  • On behalf of the General Counsel, consults with attorneys in the Office of Corporation Counsel and acts as a liaison on litigation.
  • Provides legal advice on litigation, anticipated litigation, and policy initiatives.
  • Conducts research on legal issues and prepares legal memoranda for attorneys and senior NYCPS officials.
  • Provides advice and support to program offices, including the Office of the Deputy Chancellor for Operations, on issues of statutory and regulatory compliance. Consults with City agencies as needed.
  • Reviews new State and Federal regulations and guidance and evaluates their impact on the NYCPS.
  • Provides direct support to program offices to develop and review policies and procedures.
  • Assists senior members of the Office of General Counsel in preparing for meetings with relevant Department personnel and people outside of the Department.
  • Addresses high-priority, confidential situations, and manages confidential data with the highest level of professional discretion and independent judgment.
  • Informs legal staff and Senior NYCPS officials of significant legal decisions and policy initiatives for risk management; supports the implementation of policy initiatives.
  • Drafts rules, regulations, policies, and memoranda for the NYCPS.
  • Prepares evaluation reports, performs analyses, and reviews program plans, funding, and performance related to the Department's legal matters and the Office of the General Counsel's operational matters.
  • Provides support in ongoing litigation, including requests for representation, discovery and related issues.
  • Develops and supports training requirements.
  • Analyzes and reports on the effects of City, State, and Federal legislation and regulations (proposed and enacted); prepares applicable materials.
  • Researches and provides advice and guidance on legal and operational issues related to NYCPS's critical policy initiatives.
Qualification Requirements: Minimum
  • Admission to the New York State Bar; and either 2 or 3 below.
  • One year of satisfactory United States legal experience subsequent to admission to any state bar; or
  • Six months of satisfactory service as an Agency Attorney Intern (30086).
  • Plus In addition to meeting the minimum Qualification Requirements: To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. NOTE: Selected candidates must remain members of the New York State Bar in good standing for the duration of their employment. Preferred
    • Ability to rapidly understand provisions of applicable law and regulations.
    • Ability to write clearly and concisely.
    • Efficient research skills.
    • Ability to conduct or coordinate highly complex legal research efficiently and on tight deadlines.
    • Ability to advise and render legal opinions on educational policies and practices.
    • Ability to rapidly understand provisions of applicable law and regulations in a fast-paced environment.
    • Excellent communication and interpersonal skills.
    • Litigation experience.
    Salary : $106,607 - $111,107 (Internal candidates who are selected for this position and who currently hold comparable or less senior positions within the DOE will not earn less than their current salary.)
