We're seeking an attorney with 4+ years of experience in complex litigation, investigations, or regulatory/enforcement work to play an integral role in the company's legal organization. You would be the eighth in-house lawyer, reporting to the Deputy General Counsel.
What you will do:
* Draft, update, and counsel regarding company policies and procedures, including assisting the General Counsel, Deputy General Counsel, and Compliance Committee in formulating policy and guidelines for all applicable laws related to commercial lending and financial services
* Research and identify relevant local, state, and federal law applicable or potentially applicable to the company and provide advice regarding compliance on all areas of Company activity, including sales, marketing, product offerings, internal governance and other matters
* Stay apprised of regulatory changes to proactively address potential compliance matters, including UDAP, UDAAP, FCRA, ECOA, FDCPA, TCPA and state analogues
* Assess risks, provide recommendations, and collaborate with business units on implementation of effective mitigation strategies and improvements to processes to enhance compliance
* Assist in roll-out of new products and corresponding policies, and updates to policies, procedures and company offerings based on regulatory developments
* Assist in implementation, review and mitigation of issues identified by Compliance Management and Complaint Management Systems
* Engage with regulators, policymakers, and trade associations to educate on laws furthering the company's business
* Supervise outside counsel or experts retained to assist in the review and implementation of compliance policies
* Develop training materials and make presentations to various departments regarding compliance obligations on an as needed basis
* Respond to regulatory inquiries, subpoenas, audits, and examinations, and assist in supervising a team of paralegals supporting those efforts
* Provide legal advice on compliance-related matters, including new product launches, business initiatives, and financing transactions
* Perform other compliance and regulatory assignments, as needed.
* Assist with offensive and defensive litigation, as needed, including matters arising from company functions, financing agreements, bankruptcy
proceedings initiated by individuals or small businesses, contract or employment disputes, as well as other matters
What We're Looking For:
* JD with excellent academic and professional credentials
* Member in good standing of either the New York, Virginia, or California bar, or eligible for admission upon motion
* Independent, self-starter, and self-possessed with the ability to work independently
* Flexible, with the ability to adjust to circumstances in a growing company and assist with projects on an as needed basis
* Ability to make decisions and provide advice in areas where the regulatory framework is evolving or unclear
* Strong oral and written communication skills
* Excellent presentation and training skills
* Minimum four years' experience in complex litigation, investigations, and/or compliance counseling at US-based or international law firm, or in-house with exposure and understanding of financial services industry
* Judicial clerkship a plus
