Duties Description The incumbent will be responsible for, but not limited to the following:

* Engage in legal analysis and interpretation of Alcoholic Beverage Control (ABC) related laws, rules, regulations and policies, and provide legal conclusions.

* Assist with legal research and drafting legal opinions. Provide general legal research and draft response memoranda on issues arising within the licensing bureau as required.

* Perform factual investigations and provide strategic advice/assistance to agency executives and staff on legal matters and adherence to applicable legal requirements and policies.

* Educate staff and assist with training opportunities as needed.

* Respond to inquiries and requests for information, legal opinions, and legal interpretations from the General Counsel, Deputy Counsel, and other agency staff as needed.

* Provide clear written and oral communications of legal conclusions.

* Review corporate structures to ensure they are legally structured.

* Review leases, contracts of sale, management agreements, etc. verifying they are contractual and legally appropriate.

* Prepare application disapproval letters citing ABC Law, Rules, Declaratory Rulings, Advisories etc.

* Assist licensing staff in determining whether a business is licensable under ABC Law.

* Respond to questions posed by industry attorneys and representatives.

* Perform the full range of supervisory responsibilities.

* Perform other duties and special projects as required.

Minimum Qualifications Candidates must have been admitted to the New York Stat Bar and must have had four years of experience in the practice of law subsequent to admission to the Bar.

Additional Comments NOTE:

* Travel may be required (approximately 10%), including during evening and weekends, depending on mission and assignment.

* Possession and maintenance of a valid Driver's License issued by the NYS Department of Motor Vehicle is required, or otherwise demonstrate the capacity to meet the transportation needs of the job.
