Admission to the State Bar of California and two (2) to five (5) years' experience in criminal prosecution is required. Position primarily involves prosecution of state misdemeanor offenses and municipal code violations. to supervise professional staff; to act for the City Attorney when absent; and to do related work as required.Essential Functions Deputy City Attorney: Examines general claims, warrants, and demands against the City to determine their legality; examines deeds, bonds and other documents and approves as to form; confers with and advises City departments regarding the legality of proposed expenditures and other actions; prepares briefs, opinions, pleadings and other legal papers; confers with attorneys, other City employees, and other interested parties regarding criminal prosecutions or civil cases; conducts legal research and prepares legal opinions; keeps case records and makes reports; performs investigations and prepares briefs for the trial of cases involving criminal prosecution for misdemeanors; tries civil and criminal cases and prosecutes appeals; interviews prospective complainants and Police Officers relative to the violation of penal statutes and the filing of complaints; performs legal work involved in the purchase and sale of real property by the City; drafts ordinances, resolutions, motions, and other legal documents; interprets and furnishes information regarding City ordinances; checks specifications, contracts and special assessment proceedings; drives on City business.Assistant City Attorney: Performs legal research and prepares legal opinions on all phases of municipal government; gives legal advice to City officials and department managers; drafts ordinances, resolutions, petitions, pleadings, briefs, contracts, deeds, leases and other legal instruments; represents the City and City officials in litigation, including the preparation of summonses, petitions, complaints, answers, interviewing witnesses, research, preparing briefs, negotiating settlement, appearing in court and before State Boards or Commissions, and handling appeals; passes on validity of claims against the City and makes recommendations for allowances or disallowance's thereof; handles correspondence and holds interviews, telephone conversations, conferences and negotiations in performing legal duties; may attend meetings of the Council, boards, commissions, and committees, when required; drafts proposed charter amendments; advises and assists in preparing for elections; prepares petitions for sewer and street improvements and forms for easements, bonds, complaints, notices, and assessment proceedings; when assigned to serve as a City prosecutor, prepares for trial and tries criminal cases in the Municipal Court and inferior courts and, when so assigned, shall have the rights, powers, duties and immunities of a City prosecutor.Senior Assistant City Attorney: Supervises, trains, and evaluates employees; manages caseloads and assures proper distribution of work among professional staff; makes effective recommendations regarding hiring, promotions, and transfers; effectively recommends disciplinary action as needed, up to and including termination; performs legal research and prepares the more complex legal opinions for the governing body, boards, commissions, and departments; gives legal advice to City officials and department managers; drafts a variety of legal instruments; represents the City and City officials in litigation from initial preparation through the appeals process; investigates the more serious claims and complaints by or against the City; recommends action and takes such action as is necessary; handles correspondence and holds interview, telephone conversations, conferences and negotiations in performing legal duties; attends meetings of the Council, boards, commissions, and committees, when required; may be required to assist in handling criminal matters, and when so assigned, shall have the same rights, powers, duties and immunities of a City prosecutor; drives on City business.Minimum QualificationsDeputy City Attorney:Employment Standards: Knowledge of - civil and criminal law, local laws and ordinances of established precedents, and of sources of legal reference; working knowledge of the principles, methods and practices of legal research and investigation; judicial procedures and the rules of evidence; the pleading and practice of effective presentation of court cases.Ability to - analyze legal documents and instruments; appraise and organize facts, and to effectively present evidence and other material in written or oral form; establish and maintain effective working relationships with supervisors, City officials, fellow employees, and the public.Education/Training: Any combination of education and/or experience that has provided the knowledge, skills, and abilities necessary for acceptable job performance as determined by the City. Example combination includes, but is not limited to admission to the Bar of the State of California. NOTE: Applications will be accepted from persons who have passed the California State Bar examination. A temporary appointment may be made pending admission to the California State Bar.
