Brooks & Berne, a minority owned law firm with offices in New York & New Jersey, is seeking a highly skilled and motivated Senior Associate NY Construction Litigation Attorney, primarily with expertise handling all aspects in the defense of personal injury actions arising under the New York Labor Law (commonly known as the Scaffold Law, namely, Sections 200, 240(1) and 241(6)). Our clients in these matters include property owners, general contractors, subcontractors and municipalities.
Key Responsibilities:- Litigating New York Labor Law cases from inception to resolution, including handling all aspects of pleadings, discovery, depositions, court appearances, motions, mediations, etc.
- Strong legal research and writing skills.
- Conduct thorough research on applicable laws, regulations, and case precedents to develop effective legal strategies for each stage of litigation.
- Collaborate with claims representatives and insured clients to share legal strategies and insights, providing guidance and support throughout the litigation process.
- Mentoring junior associates and collaborating with partners on strategy for complex construction labor law cases.
People Person:- Build and maintain strong relationships with claims representatives, insured clients, and other key stakeholders.
- Occasionally conduct training sessions for Legal, Claims, or other departments to share knowledge and enhance understanding of legal processes and procedures.
- Engage with diverse communities and ensure that all perspectives are valued and considered in legal strategies.
Effective Communicator:- Develop and present clear, concise, and actionable legal opinions and strategies.
- Draft and review legal documents including pleadings, motions, and other court filings with attention to detail and accuracy.
Time Management:- Familiarity with billable hours and proficient in capturing and documenting time worked to ensure accurate billing and compliance with firm and carrier policies.
Requirements:- Legal Bar Certification: Must be currently barred in New York.
- Minimum of 4-6 years of experience litigating NY Labor Law lawsuits.
- Strong research and analytical skills.
- Excellent interpersonal and relationship-building abilities.
- High proficiency in legal drafting and effective communication.
- Technical Proficiency: Familiarity with legal case management software and tools.
