Flynn Group (together with its subsidiaries Apple American Group, Bell American Group, Pan American Group, RB American Group, Hut American Group, Wend American Group, and Flynn Fitness Group) seeks an exceptional Senior Counsel, Employment & Hospitality to join its industry-recognized legal team.

In this first-of-its-kind role, you will support employment counseling and compliance efforts for Flynn Group's restaurant and fitness brands, while supporting the expansion of the Flynn Group Legal Department's employment and compliance legal services to the company's affiliated real estate business (Flynn Properties), with a focus on its hospitality portfolio. The role will report to the Associate General Counsel, Compliance, with significant direct engagement and collaboration with the General Counsel.

The position is based in our San Francisco, CA Support Center.

Responsibilities

  • Provide advice and counsel across a broad spectrum of employment issues, including wage and hour, payroll, benefits, hiring, performance management, internal investigations, leaves of absence, discipline, terminations, and employee classification.
  • Oversee outside counsel handling employment litigation matters for Flynn Group's domestic restaurant and fitness brands.
  • Investigate and respond to agency charges, government audits, and demand letters.
  • Support drafting and updating/revising company policies, including in response to changes in laws and regulations.
  • Monitor federal, state, and local legislation, regulations, and case law on employment-related matters pertinent to the company; communicate updates and recommendations as needed.
  • Coordinate with HR, Training, and Compliance to create and implement training initiatives.
  • As the first dedicated employment counsel for Flynn Properties, oversee employment litigation matters currently handled by outside counsel, including interfacing with key hotel management partners; select and manage outside counsel; prepare and monitor budgets; devise litigation strategy; report on results and trends; and advise on preventative and corrective action plans. In collaboration with the Associate General Counsel, Compliance, proactively identify and pursue opportunities to expand scope and improve quality of legal services provided to Flynn Properties.
  • Occasional travel may be involved.

Requirements

  • 7+ years of employment law (litigation) experience, including California wage and hour matters; additional experience litigating tort and/or commercial matters a plus.
  • Juris Doctor from an accredited law school; must have California Bar admission in good standing.
  • Excellent knowledge of federal and state employment laws and regulations across the country (including Title VII, ADA, FMLA, FLSA, FEHA, PAGA, etc.) and experience with federal and state agencies (DOL, EEOC, DLSE, DFEH, etc.).
  • Experience advising clients with nationwide operations on compliance and employment laws preferred; experience doing so as in-house counsel a plus.
  • Entrepreneurial mindset that enables you to work independently with little guidance, but also to use good judgment and escalate issues when needed.
  • Demonstrated ability to guide multiple objectives and initiatives simultaneously.

The good faith estimated range of pay for the above position is $165,000 - $210,000 depending on factors including but not limited to experience and skill. There is a target discretionary incentive bonus of 20%.
