DEPARTMENT PURPOSE

To represent the interests of the people of the City of Spokane and the Eastern District of Washington by the timely prosecution of individuals who violate federal law within the City of Spokane.

POSITION PURPOSE

Performs professional level legal work, in preparing and prosecuting a variety criminal cases, with a focus on narcotics and drug crimes, through special appointment with the United States Attorney's Office. This position will be employed by the City of Spokane Prosecutor's Office and will be cross designated as a Special Assistant United States Attorney through a partnership with the U.S. Attorney's Office.

SUPERVISION EXERCISED

Work has a substantial amount of independence. Employee primarily works on assigned cases within the guidelines of established office policies and relevant legal authorities, such as statutes, case law, court rules and procedures, and the rules of evidence. The Specially Appointed Assistant City Prosecutor will be assigned to a variety of criminal cases, with a focus on narcotics, drug trafficking and gang related activity through cross-designation as a Specially Appointed United States Attorney with the United States Attorney's Office for the Eastern District of Washington.

The following Responsibilities and Requirements are functions the individual who holds or desires the position must be able to perform unaided or with the assistance of a reasonable accommodation.

* Serve as the special prosecutor on cases filed by the United States Attorney's office within the territorial limits of the City of Spokane.

* Search for, interpret, and apply laws, court decisions, and other legal authorities in both written briefs and oral argument.

* Authorize and drafts criminal complaints and other legal documents in support of filing criminal charges.

* Interview and consult with involved officers, witnesses and victims.

* Prepare and present cases at all necessary court hearings, including but not limited to, initial hearing or arraignment, preliminary hearing, and sentencing.

* Confer and negotiate with defense attorneys and/or defendants at the pre-trial stage.

* Prepare pre-trial motions, exhibits, voir dire, witness examination, cross examination, jury instructions, legal arguments, and coordinate with witnesses and victims in preparation for trial.

* Argue motions, conduct voir dire, present opening statement, present gathered evidence through witness testimony and exhibits, raise and respond to legal objections, and conduct closing argument and rebuttal at trial. Prepare and argue sentencing upon criminal conviction.

* Prepare and argue post-trial motions.

* Work closely with the United States Attorney's office and staff, defense attorneys and other employees associated with the Eastern District of Washington court system.

REQUIREMENTS

Knowledge of:

* Microsoft Office products, and the ability to learn and use other relevant technologies including the City Prosecutor's case management system.

* Principals and practices of criminal law including Federal Rules of Criminal Procedure, the Federal Rules of Evidence, and the ethics rules.

* The United States Code and the Revised Code of Washington.

* Superior research and writing skills.

* Principles and practices of investigations.

* Federal or state criminal trial experience.

Ability to:

* Analyze, appraise and organize facts, evidence, and case law, and to effectively present such materials in a clear and logical manner both verbally and in writing.

* Perform in a high-pressure environment.

* Think quickly and manage large, complex investigations and prosecutions.

* Communicate and deal with the general public, sometimes under stressful circumstances.

* Conduct legal research on complex legal questions.

* Work collaboratively with colleagues.

* Function effectively in an adversarial system while maintaining a courteous and professional demeanor.

* Establish and maintain effective working relationships with co-workers, other City employees and officials, employees of the Eastern District of Washington, judicial officers, and the general public.

* Analyze and understand applicable victim's rights.

Graduation from an accredited law school with a Juris Doctorate. An active member of the bar in good standing of any U.S. jurisdiction. Two (2) years post graduate federal or state trial experience, or other relevant legal experience.

WORKING CONDITIONS

Work is performed in an office and court room environment with occasional outside the Eastern District of Washington. This position involves frequent sitting or standing for extended periods of time and the operation of a variety of standard office equipment including a computer, telephone, copy and fax machines requiring continuous and repetitive arm, hand, and eye movements.
